Terms & Conditions
1.GENERAL
(a) Unless otherwise stated in specification the attached works shall be carried out: (i) during normal working hours: and if overtime is worked at the request of the customer it shall be paid for as an extra to the contract; (ii) under normal conditions: and through no fault of myTrusted Electrical, if conditions are not normal the customer shall pay any additional cost incurred by myTrusted Electrical.
(b) myTrusted Electrical shall not be responsible for delay due to lack of instructions by the customer nor delay in completion due to strike, lockouts, fires, accidents or other circumstances over which myTrusted Electrical have no control. If any such delay involves expense to myTrusted Electrical, the customer shall pay that expense.
(c) If the work cannot be lawfully carried out without the licence or consent of the owner or landlord of the premises or any other person the customer shall obtain such consent before the work is commenced.
(d) Adequate facilities shall be provided by the customer for economical execution of the contract. These shall include access to site and if required, the free issue of a lock-up store.
(e) The quotation excludes 1) Builders work and making good; 2) Boring of holes through walls to accommodate cables, pipes and ducts; 3) All structural reinforcement required to support and accommodate the proposed plant; Except where these works are included in the specification.
2. ASBESTOS
Unless stated, the quotation does not allow for working in the vicinity of Asbestos. If during the execution of the works Asbestos is encountered, myTrusted Electrical reserve the right to withdraw their staff immediately until the site is made safe. The customer shall pay any additional costs incurred by myTrusted Electrical.
3. ALTERATIONS AND ADDITIONS
The quotation covers only the items specified: Positions of points, plant and layout are to be agreed with the customer before the work commences. Subsequent alterations or additions or additions carried out on the instructions of the customer or his agent will, if they involve additional expense, be paid for on a time and materials basis plus on-cost, unless separately quoted for.
4. UNSPECIFIED ITEMS
Where the specification includes a provisional sum for labour or equipment to be provided but not specified such as provisional sum shall be expended according to the direction of the customer.
5. DRAWINGS
The quotation includes for such working drawings as are necessary for the proper execution of the work. Special drawings supplied at the request of the customer shall be paid for by the customer as additional items.
6. PRICE ADJUSTMENT
Whilst every endeavour will be made to maintain the price quoted the quotation is based on material and labour sets prevailing at the date of quotation. The price will accordingly be subject to variation up or down by any rise or fall in material and labour costs subsequent to the date of quotation unless otherwise stated in the quotation.
7. PAYMENT
(a) Payment of the initial site survey is to be cleared before the survey can take place. All other invoices are to be paid on demand with no credit terms being accepted unless specified in the quotation document. Progress payments (if applied for) shall be made as specified in the quotation in respect of the amount of labour expended and materials delivered to site. In the event of a progress payment not being made in full within the time above mentioned, myTrusted Electrical shall have the right to stop all work forthwith and shall at their option be entitled to treat the contract as having been repudiated by the customer and to charge the customer for the work done and materials supplied on a quantum merit basis, without prejudice to myTrusted Electrical’s right to claim damages for breach of contract for any loss incurred in respect of plant or materials purchased or prepared for the work but should myTrusted Electrical’s elect to resume work upon such payment being made the expense incurred by such stoppage and the subsequent resumption of work shall be chargeable to the customer in addition to the quoted price. myTrusted Electrical reserve the right to charge interest of 2% per month on outstanding accounts and all reasonable costs incurred in recovering the outstanding account. The customer shall not reduce any payment by making any deduction from it or by setting any sum off against it without first notifying myTrusted Electrical in writing and obtaining permission in writing.
8. ON SITE SURVEYS
All site surveys will be invoiced at £72 including VAT. If the quote is accepted this cost will be deducted from the final invoice.
9. REMOTE SURVEY
If the information received from the remote survey is not complete or accurate myTrusted Electrical reserve the right to quote separately for any additional work that has not been allowed for. Any type of additional work shall be priced and agreed by the client prior to myTrusted Electrical commencing the installation.
10. TITLES AND RISK
(a) The equipment (including all materials) supplied by myTrusted Electrical under this contract shall be at the customers risk immediately on delivery to the customers premises or into custody on the customers behalf.
(b) Title in the equipment or any part thereof shall pass to the customer when payment in full has been made and the customer shall permit myTrusted Electrical to enter onto the customers premises and to re-possess the equipment at any time prior thereto.
(c) Until such time as title has been passed to the customer, the customer shall, if myTrusted Electrical so require, segregate or identify the equipment in such a way that it is clearly the property of myTrusted Electrical. However, failure to do so will not prejudice the rights of myTrusted Electrical under sub clause (b) above or other rights or remedies of myTrusted Electrical.
11. DELIVERIES AND MATERIALS
The completion of the contract is dependent upon the necessary materials being available and every endeavour will be made to use the materials specified. In event of the materials specified not being available when required myTrusted Electrical reserve the right, consistent with good practice to substitute other materials of approved manufacture.
12. LOSS OR DAMAGE
Notification should be given to myTrusted Electrical of stores delivered to site which are received by the customer or his agent. If these are damaged in transit, notification in writing should be given to the carriers within three days of delivery.
13. VALUE ADDED TAX
Value Added Tax (VAT) will be payable on all works done that are not zero rated. Because there are a number of borderline situations in the taxability of electrical contracting work, information about the nature of the work not available at the time when the quotation is made may cause more (or less) tax to be payable than was anticipated. It is therefore a condition of this contract that such tax will be paid by the customer as appears to be chargeable at the date of each invoice.
14. GUARANTEE
(a) The electrical installations shall comply with the Current Edition of the Regulations for Electrical Installations published by the Institute of Electrical Engineers.
(b) In respect of electrical installation work carried out, myTrusted Electrical will guarantee the electrical installation for a period of 1 year from date of completion of the installation. The guarantee will cover both labour and material costs incurred but does not cover the replacement of lamps or flexible cords resulting from fair wear and tear or fuses resulting from faulty appliances.
(c) In respect of all other works not included in sub-clause
(b) above: (i) myTrusted Electrical shall provide competent labour, paid at standard rates. (ii) myTrusted Electrical shall subject to sub-paragraph (iii) below, repair or replace free of charge any defective materials and/or workmanship, written notice of which is to be given to myTrusted Electrical within the twelve months of the date of completion of the contract work. (iii)
myTrusted Electrical shall not be liable beyond Manufactures Guarantees for any repair, replacement or loss, injury or damage due or alleged to be due to any defect in equipment installed and if such guarantees require payment of labour charges these charges shall be paid by the customer.
(d) myTrusted Electrical shall not be liable for replacement of lamps and fuses damaged other than
through the negligence of myTrusted Electrical nor for wear and tear (whether normal or due to improper use), neglect, accident, abuse or failure on the part of the customer to carry out routine maintenance in accordance with recommendations received by the customer from myTrusted Electrical or the sub- contractors and in so far as any repair or replacement work which myTrusted Electrical is called upon by the customer to perform is attributable to some or any of the foregoing the customer shall pay myTrusted Electrical for such work.
(e) Save and except the representations, conditions, warranties and guarantees contained in the specification and in these conditions myTrusted Electrical shall be under no liability whatsoever to the customer for any loss, injury or inconvenience caused or occasioned by any act, neglect or default of myTrusted Electrical and the sub contractor and no representation made by the customer by myTrusted Electrical or the sub-contractor before the creation of the contract between myTrusted Electrical and the customer shall affect, vary or after anything contained in these conditions.
15. LIABILITY IN RESPECT OF MATERIAL
Where a contract of purchase between myTrusted Electrical and a supplier relating to goods or materials to be used in the performance of this contra restricts, limits or excludes the liability of the supplier under the said contract of purchase, myTrusted Electrical’s liability in relation to the works in the execution of which said goods or materials are to be used shall be similarly qualified.
